Web Hosting Agreement

The Hosting Terms of Service Agreement is an agreement between Injazat Technologies ("Injazat", "the Company", "We"), and the ("Customer") set forth in the relevant order form, which is hereby incorporated into this Agreement. together with any subsequent Order Forms submitted by Customer, ("Order Form") and applies to the Hosting Service requested by Customer. By accessing Injazat and/or Customer's use of the Hosting Services, indicates that Customer has read, understood and agrees to be bound by these Terms of Hosting Service, together with the Company's Universal Terms of Service Agreement, Acceptable Use Policy, and Privacy Policy. In the event of a conflict between the Universal Terms of Service Agreement or the Privacy Policy and the terms of this Service, these Hosting Service Terms and Conditions shall prevail. 

Services.

Web Hosting Service.

Injazat Offer a premium range of shared web hosting plans for business and individuals.

The purpose of a hosting account is to host websites. Therefore, the use of the hosting account is primarily prohibited for online file storage and/or electronic file archiving. The shared business hosting plans offered by Injazat are shared hosting environments, so to ensure fast and reliable service for all of our customers, accounts that negatively impact server or network performance must correct these issues or be required to upgrade to a virtual or private server.

VPS Hosting Service (VPS).

Injazat offers virtual private server service (VPS Hosting) which allows the Customer to have complete control, and to configure the server space. So that the Customer can obtain login information for root) or (Administrator and thus the ability to fully control the server.

Injazat offers two types of VPS hosting plans:

First: Managed VPS Hosting Service - Managed VPS

Managed VPS Hosting is your own server hosting with server management. our experts oversee server management, such as operating system security patches, updates, control panel installations and professional technical support.

Each VPS server hosting subscription includes a number of cPanel accounts based on the customer plan purchased at no additional cost. If the customer wishes to upgrade the number of cPanel accounts, additional cPanel licenses can be purchased.

cPanel   license prices will not be reduced automatically to the lower level if reduced to less than the number of cPanel accounts when the customer's subscribed.

If cPanel license fails to renew for any reason, your cPanel license will be suspended.  cPanel license suspension will not result in to suspend the Customer's hosting subscription unless the hosting plan is also suspended. All cPanel functions will be discontinued Until the cPanel renewal and re-license are processed.  cPanel licenses Not refundable.

Second: Unmanaged VPS Hosting Service - Unmanaged VPS

Injazat offers a variety of plans for unmanaged VPS server, at cheaper prices because it does not come with a control panel like cPanel, nor with graphical user interface programs to manage the server.

Operating System: The company provides a set of pre-made templates for servers, which enables the Customer to choose any of them when purchasing. The company also provides a set of operating systems as (ISO files) so that the Customer can install any of them to suit his own needs.

CPU usage.

Customer agrees that it shall not use excessive CPU on any of the Company's servers. Any violation of this Policy may result in corrective action by the Company, including the imposition of additional fees, and/or disconnection and/or discontinuation of any or all Services, or the termination of this Agreement, in the sole discretion of the Company. If the Company takes any corrective action under this section, the Customer shall not be entitled to a refund of any fees paid in advance of such action.

Availability of services.

Subject to the terms and conditions of this Agreement and applicable policies, Company shall use reasonable efforts to attempt to provide the Company's Website and Services twenty-four (24) hours a day, seven (7) days a week, however  Customer understands, acknowledges and agrees that from time to time, the Company's Website and Services may become inaccessible or inoperable for any reason , including but not limited to equipment failures, routine maintenance, repairs or replacements undertaken by Company from time to time or for reasons of others that are outside the Company's control or that could not reasonably be expected, including but not limited to, interruption or failure of network communications or digital transmission links, hostile network attacks, network congestion or other failures. The Customer understands, acknowledges and agrees that the Company has no control over the availability of the Company’s website or the Services on an ongoing or uninterrupted basis and that the Company has no liability to the Customer or any other party in connection therewith.

Content Monitoring.

The Company does not view the Client Content in general, however, the Company reserves the right to view the Client Content for security and/or corrective purposes. Company may remove any element of Customer Content and/or freeze Customer's access to the Company's Website or Services in the event of any material that violates this Agreement or the Policies, as determined by Company in its sole and absolute discretion at any time and without prior notice. If Company suspends Customer's access to the Company's Website and/or Services, Company may, in its sole and absolute discretion, remove and destroy any data and files stored by Customer on its servers.

The Company expressly reserves the right to back up (but is not obligated to do so), refuse, cancel, terminate, suspend, lock, delete or modify access to or control of any Account or the Services for any reason, as determined by the Company in its sole discretion. and absolutely, including but not limited to: (1) to correct errors made by the Company in the provision of any Service, (2) to protect the integrity, stability and correction of errors made by any of the Company's affiliates or vendors, (3) to assist in the efforts of to detect and prevent fraud and abuse, (4) to comply with court orders against a customer or user, (5) to comply with law enforcement requests, including subpoenas, (6) to comply with any dispute resolution process, (7) to avoid any civil liability and To spare the Company and its officers, directors, employees and agents, including, but not limited to, cases in which the Client has sued or threatened to sue the Company and/or (8) to respond to complaints in any way related to the Client’s account or content which may lead to damage to the company's business, operations, or reputation.

Spam and damage caused. 

Some of the hosting plans We offer, include E-mail service, which allows the customer to create and send a professional e-mail using his domain name, and therefore to ensure the continuity of the service, the company does not allow the sending of unsolicited e-mail or unsolicited mass e-mail, which is an e-mail that is sent to recipients as an advertisement or unsolicited, without first obtaining the prior confirmed consent of the recipient to receive such messages (collectively, "Spam"). Spam can also include, but is not limited to, the following: news posts, advertising messages or spyware.

Nothing in this Agreement is intended to grant any right to send Spam to or through the Company's network. E-mail sent to or through the Company's network may not (1) contains invalid or non-existent domain names, (2) use any method to misrepresent or obscure any information, (3) use other means of deceptive addressing, (4) use a third party's Internet domain name, or transmit it to or through third party equipment, without the permission of the third party, (5) or contain false or misleading information in the subject line or otherwise contains false or misleading content.

Customers suspected of using the Company's products and services are contacted for the purpose of sending Spam. If the Company decides that there is a problem from the Customer, the Company will take the appropriate action to solve the situation.

The Company will not allow the use of the Company's servers and services for the purposes described above. In order to use the Company's products and services, the Customer must comply with the terms and conditions of preventing Spam.

Customer agrees that Company may immediately terminate any account (without notice) in Company's sole discretion, if Company believes it transmitting or otherwise relating to any Spam mail.

Account restrictions

Server migration. Customer acknowledges and agrees that as a normal business procedure, it may be necessary for the Company to migrate servers, which may result in the assignment of IP addresses to a different IP address, The Company does not guarantee that the Customer will be able to constantly retain any certain IP addresses.

 

Free Products. Upon termination of the hosting services, all free products offered as part of the hosting services will be cancelled.

Adjustments.

The Company may, in its sole and absolute discretion, at any time, change or modify these Hosting Terms of Service.

Customer's access to and/or use of the Hosting Services, following such changes or modifications, constitutes Customer's acceptance of these Hosting Terms of Service as of the last modified date stated above. If Customer does not agree to be bound by these Hosting Terms of Service as of the last modified date, Customer shall not access, use, continue to access and/or use the Hosting Services.

The Company may (but is not obligated) to notify Customer from time to time of changes or modifications to these Hosting Terms of Service by e-mail. It is therefore important for the customer to maintain and update the account information. The Company assumes no liability or responsibility for the failure of the Customer to receive an email notification if such failure is caused by inaccurate account information.

The Company reserves the right to modify, change or discontinue any aspect of the hosting services, including but not limited to, prices and fees, at any time, with or without notice.
